Minutes of Town Commission Meeting

March 21, 2006

Present:Mayor Richard L. Baron, Commissioner Thomas P. Bausch, Commissioner Pamela M. Busha, Commissioner E. Daniel Morris, Town Manager James J. Vardalis, Town Attorney Thomas Baird, Town Clerk Joan Barrow, Police Lieutenant Tina Ciechanowski, Building Official Gene Simmons and about sixty residents.
Absent: Vice Mayor Jon E. Chicky, Police Chief Larry McCarty
  1. Call to Order - Mayor Baron called the meeting to order at 7:00 P.M. and led the Pledge of Allegiance. The Town Clerk called the roll.

  2. Announcements:
    1. Mayor Baron noted that Attorney Tom Baird was present instead of Attorney Karen Roselli.
  3. Comments from the public on topics not on the agenda:
    1. Tony Lagana said that with the seating of a Commission there is "the hope for a total change and new beginning for the Town" and suggested that "we follow the practice some towns do and some governments do, that with the seating of a new government, all the ancillary boards tender their resignations so that more townspeople can volunteer for service."
    2. Sandra Thurlow thanked Mayor Baron for his service to the Town and presented him with a copy of her book about Sewall's Point. Mrs. Thurlow said she had "never seen anyone pitch in" the way he had. She cited his service to the Indialucie subdivision, the Town and the Children's Museum as examples of his good work for the community and described him as the "friendliest mayor" she could recall.
    3. John Brown asked Mayor Baron to apologize to his wife for comments he made three years ago "when she asked for Mr. Teplitz' resignation, he called her a ‘troublemaker.'"
  4. Public Hearings & Presentations:
    1. Ordinance 319, Revising the Definition of "Market Value" in the Model Flood Damage Protection Ordinance - Attorney Baird read the ordinance, by title, for a second reading.

      MOTION:made by Commissioner Morris, seconded by Commissioner Busha, APPROVING ORDINANCE 319 ON SECOND READING.

    2. Ordinance 320, Extending the Maximum Length of Boat Docks Extending Into the Indian River from 250' to 500' or the Length Permitted by the DEP, Whichever is Less - Attorney Baird read the ordinance, by title, for a second reading.

      MOTION:made by Commissioner Morris, seconded by Commissioner Busha, APPROVING ORDINANCE 320 ON SECOND READING.

      Commissioner Bausch pointed out that the lagoons and bays that do not go into the Indian River directly had not been addressed in the ordinance. He suggested an exemption be considered because long docks in these areas could impair navigation.

      Commissioner Busha agreed. She said that she had spoken to the attorney before the meeting and he suggested that a phrase be added that states "provided that the Town shall evaluate impacts to navigation." Commissioner Busha added that she would prefer that lagoons and bays just be excluded, using dictionary definitions for both.

      Attorney Baird said that both concerns could be addressed by adding the following phrase: "provided, however, the Town shall evaluate the impact of the proposed dock within bays and lagoons as to navigation." He explained that such an amendment would not require another second reading of the ordinance since it is not a substantial change.

      AMENDED MOTION:made by Mayor Morris, seconded by Commissioner Busha, APPROVING ORDINANCE # 320 WITH THE ADDITIONAL LANGUAGE PROPOSED BY THE TOWN ATTORNEY.

      William Harte thanked the Commission for considering the bays and lagoons. He also asked the Commission to consider the aesthetics of a 500' dock on a small lagoon.

      Charles DeGarmo told the Commission that he recently built a 200' dock at 59 North River Road and it lines up with all the other docks in the area. He said that a 500' dock would create a navigational hazard, especially since there is no requirement that docks be lighted at night.

      Commissioner Bausch pointed out that the proposed ordinance is for docks on the Indian River, not the St. Lucie River.

      A vote was taken on the motion and it was:

      MOTION:made by Commissioner Morris, seconded by Commissioner Bausch, APPROVING THE ITEMS ON THE CONSENT AGENDA.

      Commissioner Bausch told Mayor Baron it had been an honor and a pleasure to serve on the Commission with him and Vice Mayor Chicky.

      Mayor Baron replied that it had been his pleasure.
